§ 1 Basic information

1. The Online Store www.diligent/eu/com (hereinafter referred to in short as the "Store") enables you to make remote purchases via the Internet, on the terms set out in these Regulations.

2. The store is owned and run by: Diligent LTD Bonarka 19/5 Kracow 30-415 NIP: 5842769318; Regon: 526002240 (hereinafter referred to as the "Seller")

3. Items available for sale are presented and described on the Store's website. The given prices of items are total net prices, and delivery charges, in accordance with the selected option, are provided separately, unless, due to the value of the order, the Seller provides the delivery cost.

4. Items that are currently in stock are marked as available and orderable on the terms set out in these Regulations.

5. Items that are not in stock are marked with the description: Out of stock. Their order is possible only on individually agreed terms and conditions, after prior contact with the Seller.

6. The seller is obliged to deliver the purchased items in a defect-free condition. The items offered to you are new and originally packed.

8. The term "consumer" is understood as a natural person who has concluded a sales contract with the Seller without a direct connection with their business or professional activity.

 

§ 2 Terms of use of the Store

1. When using the Store, you are obliged to:

  • not to provide or transmit content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties,
  • not disturbing its functioning,
  • not taking actions such as: sending or posting unsolicited commercial information (spam) within the Store,
  • use the Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as with the general principles of using the Internet.

 

§ 3 Orders

1. To place an order in the Store, you must have an e-mail account and enable the function of accepting (functional) cookies and pop-up windows in your browser.

2. Placing an order is done by performing the following steps:

  • selecting the items you are interested in and adding them to the basket;
  • going to the order page, marked with the basket icon in the menu, where you can see a summary of selected items and their prices;
  • choosing shopping options by registering your own user account or as a guest;
  • completing the form by providing the necessary personal data
    and contact details;
  • selection of the form of delivery of the ordered items;
  • confirmation of reading and accepting these Regulations;
  • choice of payment method;
  • confirmation of placing an order by clicking the "Order" button
    with an obligation to pay.

3. In the event of incorrect data provided in the order, the Store will contact you via e-mail or telephone in order to correct them, if it is possible to make contact.

4. The store will inform you via a message on the website and by sending an e-mail about the positive verification of the data provided and confirmation of the order. At the moment of sending this message, a sales contract is concluded between you and the Seller. The message will contain the data necessary to make the payment, in accordance with the selected method and the date of payment.

5. In the case of payment by bank transfer in the Przelewy24 system and payment in the PayPal system, you will be redirected to the appropriate website to make it immediately after placing the order.

 

§ 4 Discounts

1. Only registered users can use discounts in the Store.

2. Quantity discounts described on individual product pages apply in the store.

 

§ 5 Payments

1. To pay for ordered items, you can use the following payment methods:

  • bank transfer to the Seller's bank account, including using the Przelewy24 system,
  • payments in the PayPal system,
  • cash payment for the COD shipment,

2. Payments by bank transfer and payments in the PayPal system should be made within 3 days from the date of concluding the sales contract.

3. Payment in cash should be made together with the delivery of the COD shipment, and in the case of personal collection - upon collection, which should take place within 3 days from the date of concluding the sales contract.

 

§ 6 Delivery and collection

1. If you choose payment by bank transfer or PayPal, the ordered items are shipped within 48 hours (the time given applies to working days) from the moment the payment is received by the Seller, unless you decide to collect them in person.

2. If you choose the COD shipment, it will be sent within 48 hours (the time given applies to working days) from the date of sending the message confirming the acceptance of the order.

3. The cost of shipping is always given before placing an order and does not include any additional fees.

4. If you purchased a given item as a consumer and it is to be sent by the Seller, the risk of its accidental loss or damage passes to you only upon its release. However, in a situation where you wish to use the services of a carrier other than the one offered by the seller, the handover of the item is understood as entrusting it to that carrier.

5. If you purchased a given item as a consumer, the Seller will deliver a confirmation of the conclusion of a distance sales contract in paper form with it. The content of the confirmation is information about the acceptance of the order and the text of these Regulations.

6. A receipt is always attached to the purchased items, and a VAT invoice on request.

 

§ 7 Complaints

1. If, in your opinion, the purchased item is defective, you can exercise your rights under the warranty, in accordance with the current provisions of Polish law.

2. Complaints should be submitted by post by returning the goods together with a written description of the defect and demands to the Seller.

3. If you purchased a defective item as a consumer, you can request from the Seller:

  • its repair or replacement with a new one;
  • reduction of the price (proportionally appropriate to the impairment);
  • withdrawal from the contract (if the defect is significant).

4. You will receive information on how the complaint is handled immediately. Failure to respond to your complaint as a Consumer within 14 days is tantamount to recognizing the expressed request as justified.

5. Repairs and replacements will be made immediately so as not to cause you excessive inconvenience.

6. If the complaint is considered justified, its cost is borne by the Seller, who may ask you to show proof of payment for the shipment.

 

§ 8 Withdrawal from the contract

1. If you purchased a given item as a consumer, it is possible to withdraw from the sales contract within 14 days from the date of receipt of the purchase in accordance with the Act of 24 June 2014 on consumer rights.

2. The right of withdrawal does not apply to items that we deliver to you in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package has been opened after delivery.

3. In the event of withdrawal from the above-mentioned contract, we return to you all payments received from you, including the costs of delivering the item (except for additional costs resulting from the method of delivery chosen by you other than the cheapest usual method of delivery offered by us), immediately and in any case case, no later than 14 days from the day on which we were informed about your decision to exercise the right to withdraw from the above-mentioned contract.

 

§ 9 Use of personal data

1. When making purchases in the Store, you agree that the data required in the user account creation form or in the order form will be used by the Seller to record sales and fulfill orders. Your data may also be transferred to entities providing transport services for the purpose of delivery of purchased items.

2. If you agree to receive information about promotions and news in the Store's offer and to receive offers from the Store's partners, such information will be sent to the address provided by you in the form of an e-mail. Your consent may be withdrawn at any time.

3. As part of the performance of the contract with the Buyer, the Store is authorized to send an invitation to complete the after-sales survey to the Buyer's e-mail address. The survey is used to examine opinions about the transaction. The buyer may voluntarily complete the survey.

4. You have the right to inspect, correct, update or delete your data at any time using the options available on your user account or by contacting the Seller.

 

§ 10 Out-of-court dispute resolution

1. If you purchased the item as a consumer, you can use it out-of-court methods of dealing with complaints and pursuing claims.

2. Detailed information on the possibility of using out-of-court methods of dealing with complaints and pursuing claims as well as the rules of access to these procedures are available at the offices and on the websites of poviat or municipal consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Voivodship Inspectorates of the Trade Inspection and at the Internet addresses of the Office of Competition and Consumer Protection:

3. As consumers, you have e.g. the following possibilities out-of-court methods of dealing with complaints and pursuing claims:

  • apply to the permanent amicable consumer court operating at the Trade Inspection with a request to settle the dispute arising from the concluded sales contract;
  • apply to the provincial inspector of the Trade Inspection with a request to initiate mediation proceedings regarding the amicable settlement of the dispute.

§ 11 Final Provisions

1. In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply.

2. Any disputes arising between the Customer who is not a consumer and the Seller will be settled by the District Court or the District Court in Bielsko-Biała, depending on the subject of the dispute and in accordance with the provisions on material and functional jurisdiction.
